The Sunshine law, and the 8-21-07 meeting!

One simple question, was the sunshine law violated by the BOA, and more importantly the City Attorney at last nights "open" meeting?"

At last nights meeting a Crestwood Citizen asked Board President Roby for a copy of the items pertaining to the PGAV proposal on the plaza. Mr. Roby asked Mr Golterman if that was OK, and I am told Mr. Golterman said NO! Now, once the paperwork is on the floor, is that not public information? I think it is, and as such should have been allowed to be seen!

Remember folk's this is OUR tax money being spent by the the City fathers, and as such, I believe we have a perfect right to know how it's being spent! Mr. Golterman should have known that a simple FOIA form being filed will get us the information we want, and if he didn't, well I will be filing said form ASAP, so now he has the "heads up" to file an injunction against it.

While I am at it, I will also be asking for a copy of the "agreement, contract" between the City, and PGAV reference the latest expenses ($1400.00) for giving the report last night.

NEW INFORMATION JUST IN! I am now told that the attorney who advise our citizen that she could not have the packet was from a law firm at the meeting, and not Mr. Rob Golterman! This information came from the citizen who asked the question herself, and not from my source (who apparently was wrong!) I respectfully regret the error!

January 17, 2007 edition of the Suncrest Call, or why no board minutes from the civil service meeting?
Now this one is a very interesting edition folks! Read the column and editorial by Mr. Burke Wasson. I have never heard of a civil service board meeting, or for that matter any board meeting where no minutes were taken.

It seems the C/A hasn't either, as he said he doesn't have an answer for it either. Well, not only is it like pulling teeth to get a meeting date and time from City hall when it comes to specialized boards (TIF,TDD,CID,) it now appears that this one wasn't publicized very well either!

Why was the Crestwood Mall voted for a 353 before Mayor Fagan left office?

Ask Burke Wasson if he received a copy of the PGAV RFP.

Can the city post the Crestwood Mall RFP so all developers or buyers can see their plan?

I thought the goal was to rebuild the Crestwood Mall.

Ask Gilmore Bell lawyer why only certain developers can see this RFP.

Who is sending out the RFP? The City of Crestwood which is a government entity? PGAV? Gilmore Bell Law Firm?

And what happened why Mayor Roy Robinson was in office during the 66 Drive-In?

Judge denies city's second attempt to recoup legal fees

Six plaintiffs filed a lawsuit against the city last year, alleging two former aldermen conspired to violate the First and 14th Amendment rights of public speakers during Board of Aldermen meetings.

Dont forget that Tom posted that he spoke to the Mayor and Mr. Roby about speaking before the Board on this matter and BOTH told him no citizen would be allowed to do so. Mr. Golterman works for them, so who do you think told Mr. Golterman what to say when a citizen asked for a copy of the PGAV work product?
Another concern is the report by Tom that MR. Roby said PGAV was not hired by the BOA yet there is a bill for their work.
Didnt the Mayor when he ran for office promise to be a full time Mayor and to be watching over City Hall daily? Are you trying to tell me that he had nothing to do with these and the other Sunshine Law and Charter violations? Come on people, get a clue already!

Good Lord, we have a drunk playing on his computer! Have you ever had a few drinks and said some really dumb stuff and then later had someone remind you of what you'd said. Some of the comments put on this blog are pathetic, either someone so bored with their life and/or drinking daytime but I guess we should be grateful we help them out by letting them vent. I received a phone call from Frank Myers stating that there was a rumor that the City was not allowing citizens to receive a copy of the RFP for the mall. I am happy to say that this is not true. The City has been giving copies of the RFP to citizens when requested.

But, she is giving it out, so let's get up there and get a copy for ourselves.

By the way, she answered me very quickly, as did Frank Myers, so I am a happy camper. That is until we start talking about 353's and eminent domain!

9:36 PM blogger: If they wish leave and return to county so be it! By the way, that will be a very larger saving for Crestwood. We gained next to nothing in tax revenue, but pay out large sums to the Afton fire protection district (and others) to keep the area.

If you were to ask them about the money they saved by joining Crestwood I bet they will change their mind!

Well, I got my copy of the RFP and it is just as i suspected, absolutly of no use to anyone but a potential developer. It simply states what we already know about our great city. So Tom, why on earth were you babbling on about everybody should run to city hall and demand a copy of this story of Crestwood. Did you expect us to find some hidden code word among the information. I am disappointed.

Then why did the Mayor and the Pres. of the BOA deny any comment at the meeting or copies of what you now have in your hand? Was it only to keep it out of this weeks local newspaper? What other reason's where you the mayors right hand man told two different stories about the reason for the meeting?

As I understand it, this was discussed, and voted on in a "session" that we were not allowed to be at!

Now that being said, they would have to mis-inform me to keep the "session" private, no?

Am I happy? Not a bit of it my friend, in fact, I have lost a lot of respect for most of the folks on that dias!

You see Tom the executive meetings that the C/A, Mayor and Golterman were calling to review real estate were illegal! All the talk about a RFD for the Mall should have been done in public. Look up the reason that a Govt can call a meeting that is about real estate and you will see it can only be done if the City wants to BUY, SELL or LEASE a property. How were those meetings held using the law? It was a violation of State Law my friend, and you sat there and drank the kool aid.

Correct me if I'm wrong, but closed executive sessions are allowed for personnel matters and real estate matters, as the 11:18 blogger says, buying and selling.

The explanation for these meetings that are being discusssed here should be addressed by Robert Golterman, the City Attorney. This is what he is being paid for. If they were wrong, it is his fault and his duty to give an explanation.

The BOA will needs to remind Mr. Golterman of this duty. They rely on him for his legal expertise.

By the way does anyone know if Alderman Pickel reads any of his E-mails? I have sent him at least six with no response! Is this "taxation without reprensation," well no Alderman Knarr responds every time!

So you don't think that Tom, as a citizen of Crestwood and a registered voter, deserves a response from the elected official who represents his ward? Have you ever heard of something called democracy?

Furthermore, I don't think Tom has to stir the pot. It is already stirred up at City Hall.

Finally, your comment about "constructive long term solutions" is interesting. Please tell me, how many of these "constructive long term solutions" have come out of city hall in the past five or six years?

One has to wonder why someone who finds this site so bad reads it.

But then one does not have to wonder long.

And, we all know who that is.

However, I personally get a huge kick out of this sad-sack. It makes me realize how grateful I am to realize the difference between this blogger and all the really wonderful bloggers who apparently irritate this sad-sack by knowing too many facts. So while the blogger keeps up his sorehead posts, I read them and put the whole thing in perspective and feel confident this administration has a lot of competent supporters in comparison. What a relief.

I am glad that "code of conduct" went down, as at least two Alderman would be up on charges of dis-respecting a citizen.

Who you ask, well first ward Alderman Bland for his body language, and refusal to pay attention to a speaker at a BOA meeting (two to be exact,) and Alderman Pickel for not answering several message's from a constituant.

This is a public forum as is a BOA meeting, so why not answer?

Well, apparently Pickel was groomed to follow Kelleher, that fine outstanding representative of (gosh who) who spent his whole term being disrespectful, stupid, or absent. It is a shame Pickel finds it necessary to show disdain for any fellow board member or a resident and bring back memories of his predecessor. This, sadly, is not in his job description.

As for Bland. He is pretty much an airbag. In fact, is getting pretty good at it. I think he is definitely in line for grandstander of the year. These two keep forgetting they represent their whole ward and the whole city and not just their little group of gypsies. I thought they would do better and help us get past the nightmare of the past few years of RobertonFagan
Greer. But they aren't smart enough and are bereft of integrity. Otherwise, would they not be respectful and attentive?

I am amazed at the fact that somebody on this blog has so much animosity toward Martha Duchild that he/she has to continually bring up her name in such a tongue-in-cheek manner.

Makes me think that maybe it's because she is smarter and more intelligent than they, and is a woman. It seems that a few bloggers are intimidated by women who possesses a lot of common sense.

It's just laughable to me because if she were a man and stood up and spoke her mind, it would be a totally different story. No one would have posted anything negative at all would they????

I think some on this blog are jealous of the fact that she is not afraid of voicing her opinions. It's all sticks and stones to her, my friends. She will continue to care about her city in spite of you and your irritating banter.

And, you can keep it up if you so desire, but I can tell you right here and now that you will never, ever see her reply to your foolishness no matter how hard you try. That's because she is so far above all you idiots, it's speaks volumes about her posture and class.
